            WHEREAS,the following persons, being the owners of all the real property hereinafterdescribed, did file with the City Clerk a petition asking that the said tractor parcels of land be annexed to and become a part of the City of Wetumpka; and

 

            WHEREAS,said petition did contain the signature(s) of the owner(s) of the describedterritory and a map of said property showing its relationship to the corporatelimits of the City of Wetumpka; and

 

            WHEREAS,the City Council of the City of Wetumpka, being the governing body thereof, hasfound and determined that the said property hereinafter described is contiguousto the corporate limits of the City of Wetumpka, and that none of the saidproperty lies within the corporate limits or police jurisdiction of any othermunicipality; and

 

            WHEREAS,the governing body did determine that it is in the public interest that saidproperty be annexed to the City of Wetumpka and it did further determine thatall legal requirements for annexing said real property have been met pursuantto §§ 11-42-20 through 24, Code of Alabama (1975).

 

 

            NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WETUMPKA, ALABAMA,AS FOLLOWS:

 

 

            Section1. The Council of the City of Wetumpka, Alabama, finds and declares as thelegislative body of the City that it is in the best interest of the citizens ofthe City, and the citizens of the affected areas, to bring the territorydescribed in Section 2 of this Ordinance into the City of Wetumpka, Alabama.

 

 

            Section2.  The boundary lines of the City ofWetumpka, Alabama, be and the same are hereby rearranged so as to include allof the territory heretofore encompassed by the corporate limits of the City ofWetumpka, Alabama, and in addition thereto the following described territoriesto-wit:

PARCEL “A”

 

Commence at a point known as the Southeast Corner of Section 25,T-18-N, R-18-E, Elmore County, Alabama; thence S 89°56’16” W 2,582.69’ to apoint; thence N 14°33’25” E 345.05’ to a point; thence N 64°48’19” W 183.61’ toan iron pin located on the South Right-of-Way (60’) of Huntress Street and theWest Right-of-Way (R.O.W. varies) of U.S. Highway 231; thence leaving said WestRight-of-Way (R.O.W. varies) of U.S. Highway 231 and along said SouthRight-of-Way (60’) of Huntress Street N 75°26’06” W 199.11’ to an iron pinlocated in a curve at the intersection of said South Right-of-Way and the EastRight-of-Way (60’) of Captain Crommelin Road; thence leaving said SouthRight-of-Way (60’) of Huntress Street and southwesterly along said curve andEast Right-of-Way (60’) of Captain Crommelin Road

S 14°33’54” W 125.00’ to an iron pin; thence S 86°29’33” W 443.26’to an iron pin; thence

S 43°14’15” W 67.80’ to an iron pin; thence N 75°26’06” W 316.00’to an iron pin;

thence N 14°33’54” E 357.00’ to an iron pin located on the SouthRight-of-Way (60’) of Huntress Street; thence along said South Right-of-Way(60’) of Huntress Street S 75°26’06” E 734.92’ to an iron pin located in acurve; thence leaving said South Right-of-Way (60’) of Huntress Street and southeasterlyalong said curve (Chord Bearing S 30Ί26’06” E, Chord Distance 49.50’, Radius35.00’) to an iron pin and the point of beginning.  Containing 5.04 acres, more or less, andlying in and being a part of the SE 1/4 of the SW 1/4 and the SW 1/4 of the

SE 1/4 of Section 2, T-18-N, R-18-E, Elmore County, Alabama.

As recorded February5, 2019 Deed RLPY 2019, page 4966, Probate Office, Elmore County,Alabama. 

 

               We further certify that said property is contiguous to the Corporate Limits ofthe City of Wetumpka, Alabama, and that none of said property lies within thecorporate limits or police jurisdiction of any other municipality. The taxidentification number for the subject parcel is:

16-07-25-0-007-032.009. A map ofsaid property reflecting the parcels and the location of the Wetumpka CorporateLimits adjacent to these parcels is attached hereto and incorporated herein.

 

                Section3.  This Ordinance shall be published asprovided by law, and a certified copy of same, together with a certified copyof the petition of the property owners, shall be filed with the Probate Judgeof Elmore County, Alabama.

 

            Section4.  The territory described in thisOrdinance shall become a part of the corporate limits of the City of Wetumpka,Alabama, and voting in Council District No. 5, upon publication of thisOrdinance as set forth in Section 3 above.

 

 

            Adoptedand approved this the 4th day of March, 2019.
